3. Using Our Website

You may use the website for lawful purposes only.

You must not:

  • Use the website for fraudulent or unlawful activities.
  • Attempt to gain unauthorised access to our website, servers or systems.
  • Introduce malware, viruses or other harmful code.
  • Interfere with the operation or security of the website.
  • Attempt to obtain another customer’s account information.
  • Use automated systems to scrape or harvest website information without our permission.
  • Impersonate another person or entity.
  • Submit false or misleading information.
  • Use the website in a way that infringes another person’s rights.
  • Use the website for any purpose prohibited by applicable law.

We reserve the right to restrict or suspend access where reasonably necessary to protect our website, customers or business, subject to applicable law.

4. Products and Product Information

We make reasonable efforts to ensure that product information displayed on our website is accurate and up to date.

Product information may include:

  • Product names
  • Manufacturer information
  • Product descriptions
  • Technical specifications
  • Images
  • Compatibility information
  • Pricing
  • Availability
  • Warranty information

Much of the technical information relating to products is provided by manufacturers, distributors and suppliers.

Product specifications, images, colours, packaging and other details may change from time to time.

Where a product specification is important to your intended purchase, we recommend confirming the specification with us before placing your order.

Nothing in this section limits any consumer rights arising from inaccurate, misleading or materially incorrect product information.

5. Product Images

Product images are generally provided for illustrative purposes.

Where a product image differs from the actual packaging, colour or appearance of the product supplied, the manufacturer’s actual product specifications and packaging may apply.

We will take reasonable steps to ensure that product images and descriptions accurately represent the products being offered.

6. Product Compatibility

Customers are responsible for ensuring that products selected are suitable for their intended application where compatibility depends on the customer’s existing equipment or configuration.

This may include compatibility relating to:

  • Motherboards
  • CPUs
  • RAM
  • Graphics cards
  • Power supplies
  • Storage devices
  • Laptop accessories
  • Cables
  • Networking equipment
  • Operating systems
  • Other computer components

Where compatibility is unclear, please contact us before placing your order.

If you order a product that is technically unsuitable for your particular system or application, this may be treated as a customer ordering error rather than a defective-product claim, subject to applicable law.

7. Prices

All prices displayed on the website are in South African Rand (ZAR) unless otherwise stated.

We make reasonable efforts to ensure that pricing information is accurate.

Prices may change from time to time.

Where a pricing error occurs, we will take reasonable steps to correct the error.

If an order has been affected by a material pricing error, we will contact the customer and explain the available options, subject to applicable law.

No customer will be required to pay an amount higher than the price properly applicable to the transaction without their agreement where the law requires otherwise.

8. Promotions and Special Offers

Promotional prices and special offers may be subject to specific terms.

Where applicable, a promotion may specify:

  • Start and end dates
  • Product availability
  • Quantity limitations
  • Eligibility requirements
  • Other applicable conditions

Promotions cannot be combined unless expressly stated.

Nothing in a promotional term limits statutory consumer rights.

9. Product Availability and Supplier Stock

ALP IT Solutions operates an online retail and dropshipping model.

Product availability may depend on stock information supplied by our suppliers and fulfilment partners.

We make reasonable efforts to maintain accurate availability information, but stock can change before an order is fulfilled.

If a product becomes unavailable after an order has been placed, we will contact the customer and, where appropriate, offer options such as:

  • Waiting for stock
  • Selecting an alternative product
  • Receiving an applicable refund

Where the law requires a particular remedy, that remedy will apply.

10. Our Dropshipping and Fulfilment Model

ALP IT Solutions operates an online retail model in which products may be sourced and fulfilled through third-party suppliers and fulfilment partners.

This may mean that a product is dispatched directly from a supplier or distribution facility to the customer.

Our use of suppliers and fulfilment partners does not change the customer’s purchase relationship with ALP IT Solutions.

Where necessary to fulfil an order, we may provide relevant customer information to the supplier, fulfilment partner or courier in accordance with our Privacy Policy.

11. Orders

To place an order, you must provide accurate and complete information.

This may include:

  • Your name
  • Email address
  • Telephone number
  • Billing information
  • Delivery address
  • Payment information required by the applicable payment provider

You are responsible for checking your order details before completing your purchase.

12. Order Confirmation

After placing an order, you may receive an electronic order confirmation.

An order confirmation confirms that we have received your order request.

Receipt of an order does not necessarily mean that the product has been dispatched or that every aspect of the order has been finally confirmed.

Where an issue arises with stock, pricing, payment, fraud prevention or another material aspect of an order, we will contact you and handle the matter in accordance with applicable law.

13. Acceptance and Cancellation of Orders

ALP IT Solutions may decline or cancel an order where reasonably necessary, including where:

  • A product is unavailable.
  • A material pricing or product-description error has occurred.
  • Payment has not been successfully received.
  • A transaction appears fraudulent.
  • The customer has provided materially incorrect information.
  • The order cannot reasonably be fulfilled.
  • Cancellation is otherwise permitted by applicable law.

Where an order is cancelled and a refund is due, the applicable amount will be refunded in accordance with our Returns & Refund Policy and applicable law.

We will not use this clause to unlawfully avoid a consumer’s rights after a valid transaction has been concluded.

14. Payment

Payments made through our website may be processed using third-party payment providers, including PayFast.

Payment must be successfully authorised or received before an order is processed for fulfilment, unless otherwise agreed by ALP IT Solutions.

Customers must only use payment methods and payment accounts that they are authorised to use.

We do not intentionally store complete payment-card information where that information is processed directly by the relevant payment provider.

For more information about how payment-related information is handled, please refer to our Privacy Policy.

15. Failed, Reversed or Unverified Payments

If payment is:

  • Declined
  • Reversed
  • Cancelled
  • Not received
  • Insufficient
  • Flagged for verification
  • Otherwise unsuccessful

we may place the order on hold or cancel the order until the payment issue has been resolved.

We may request reasonable information to verify a payment or transaction.

We will never ask you to provide your complete card number or card security code by ordinary email.

16. Delivery

We arrange delivery through appropriate courier, logistics or fulfilment partners.

Delivery times displayed on the website are estimates unless expressly stated otherwise.

Delivery may be affected by:

  • Product availability
  • Supplier processing
  • Courier delays
  • Incorrect delivery information
  • Public holidays
  • Severe weather
  • Industrial action
  • Power or infrastructure disruptions
  • Unforeseen events
  • Other circumstances outside our reasonable control

We will take reasonable steps to keep customers informed where a material delivery delay occurs.

17. Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

If a customer provides an incorrect or incomplete address and additional delivery costs are incurred as a result, the customer may be responsible for those reasonable additional costs, subject to applicable law.

Customers should ensure that someone is available to receive the delivery where required by the courier.

18. Delivery of Products Through Third Parties

Products may be delivered directly from a supplier, distributor or other fulfilment partner.

The parcel may therefore contain supplier or distributor branding or documentation.

This does not change the fact that the customer purchased the product through ALP IT Solutions.

19. Free Delivery

Where ALP IT Solutions offers free delivery above a specified order value, the applicable threshold and conditions will be displayed on the website or applicable promotion.

Unless otherwise stated, free delivery applies only to qualifying orders and may be subject to geographic, product or promotional conditions.

20. Risk and Delivery

ALP IT Solutions will handle delivery and risk in accordance with applicable law.

Nothing in these Terms is intended to transfer risk to a consumer in circumstances where applicable law places that risk on the supplier.

21. Returns and Refunds

Returns, exchanges and refunds are governed primarily by our Returns & Refund Policy.

The Returns & Refund Policy forms part of these Terms & Conditions.

The policy covers, among other matters:

  • Faulty products
  • Defective products
  • Damaged products
  • Incorrect products supplied
  • Customer ordering errors
  • Change-of-mind returns
  • Warranty claims
  • Return shipping
  • Refunds
  • Exchanges
  • Product assessments

Nothing in our Returns & Refund Policy or these Terms limits any statutory consumer right.

22. Consumer Protection Act

ALP IT Solutions respects the rights and protections provided to consumers under the Consumer Protection Act 68 of 2008 (CPA).

The CPA provides various consumer protections relating to matters including:

  • Fair and responsible marketing
  • Product information
  • Quality of goods
  • Consumer agreements
  • Returns
  • Warranties
  • Refunds
  • Unfair business practices
  • Consumer complaints

Where the CPA applies to a transaction, ALP IT Solutions will comply with its applicable requirements.

23. Consumer Warranty Rights

Goods supplied by ALP IT Solutions may be subject to statutory consumer warranties as well as manufacturer’s, distributor’s or supplier’s warranties.

Our Returns & Refund Policy explains how customers can report faults and request assistance.

A manufacturer’s warranty does not replace statutory consumer rights.

24. Electronic Communications and Transactions

Transactions conducted through our website are electronic transactions.

The Electronic Communications and Transactions Act 25 of 2002 (ECTA) recognises electronic communications and transactions and contains requirements applicable to electronic transactions.

Where applicable, electronic records, order confirmations and communications may be retained as records of transactions.

We will provide customers with the information and documentation required by applicable law.

25. Customer Accounts

Customers may create an account on the website where this functionality is available.

You are responsible for keeping your account information accurate and protecting your login credentials.

You must notify us if you believe that your account has been accessed without authorisation.

We may restrict or close an account where reasonably necessary for security, fraud prevention or other legitimate purposes, subject to applicable law.

26. Privacy and Personal Information

ALP IT Solutions processes personal information in accordance with our Privacy Policy.

Our Privacy Policy explains:

  • What information we collect
  • Why we collect it
  • How we use it
  • When we share it
  • How we protect it
  • How long we retain it
  • Your rights under POPIA

By using our website and placing orders, you acknowledge that your personal information will be processed as described in our Privacy Policy and in accordance with applicable law.

27. Supplier and Fulfilment Information

To fulfil an order, we may provide necessary customer information to suppliers, fulfilment partners and delivery providers.

For example, information such as your name, delivery address, telephone number and order details may need to be provided to a supplier or courier.

Our Privacy Policy contains further information about this processing.

28. Product Reviews

Customers may be invited to submit product ratings and reviews.

Reviews must be honest and relevant to the product.

You must not submit content that:

  • Is unlawful
  • Is defamatory
  • Is abusive
  • Contains hate speech
  • Contains malicious code
  • Contains another person’s private information
  • Is deliberately misleading
  • Is promotional spam
  • Infringes another person’s rights

ALP IT Solutions may moderate or remove reviews that violate these requirements.

Where appropriate, reviews may be displayed publicly on the relevant product page.

Further information about the processing of review information is contained in our Privacy Policy.

29. Intellectual Property

Unless otherwise stated, the website and its original content are owned by ALP IT Solutions or used under licence.

This may include:

  • Website design
  • Text
  • Graphics
  • Logos
  • Original images
  • Marketing materials
  • Website functionality
  • Page layouts
  • Other original content

You may not reproduce, modify, distribute or commercially exploit our original website content without appropriate permission.

Manufacturer and supplier trademarks, logos, product images and intellectual property remain the property of their respective owners.

30. Third-Party Intellectual Property

Product names, trademarks, logos and other intellectual property belonging to manufacturers, suppliers and other third parties remain the property of their respective owners.

Nothing on this website grants you ownership of third-party intellectual property.

31. Third-Party Websites and Services

Our website may contain links to third-party websites and services.

These may include payment providers, manufacturers, suppliers, social-media platforms and other services.

We do not control third-party websites and are not responsible for their content, availability, security or privacy practices.

Your use of third-party websites is subject to their applicable terms and policies.

32. Website Availability

We aim to keep our website available and functioning properly.

However, we do not guarantee that the website will always be:

  • Available
  • Uninterrupted
  • Error-free
  • Completely secure
  • Free from technical problems

The website may occasionally be unavailable because of maintenance, upgrades, technical failures or circumstances outside our reasonable control.

33. Website Security

We take reasonable steps to protect our website and systems.

However, no internet-based system can be guaranteed to be completely secure.

Customers should maintain appropriate security on their own devices and should not share account passwords or other confidential credentials.

34. Errors and Corrections

Despite our reasonable efforts, the website may occasionally contain:

  • Typographical errors
  • Product-description errors
  • Pricing errors
  • Stock-information errors
  • Image errors
  • Technical errors

Where we identify a material error affecting an order, we will take reasonable steps to correct the matter and communicate with the affected customer.

Nothing in this clause limits rights available to consumers under applicable law.

35. Limitation of Liability

To the extent permitted by law, ALP IT Solutions will not be liable for losses arising solely from:

  • Temporary website unavailability
  • Events outside our reasonable control
  • Third-party website failures
  • Third-party service interruptions

  • Customer-provided information that is incorrect or incomplete

However, nothing in these Terms excludes or limits:

  • A consumer’s statutory rights
  • Liability that cannot legally be excluded or limited
  • Liability arising from fraud or fraudulent misrepresentation
  • Any other liability that applicable law prohibits us from excluding or limiting

We do not use these Terms to remove or reduce consumer remedies provided by applicable law.

36. Events Outside Our Reasonable Control

ALP IT Solutions will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including where applicable:

  • Cybersecurity incidents
  • Industrial action
  • Transport disruptions
  • Supplier disruptions
  • Government action

  • Other extraordinary events

Where such an event affects an order, we will take reasonable steps to minimise the impact and communicate with affected customers.

37. Fraud Prevention

We may use reasonable measures to identify and prevent fraudulent or suspicious transactions.

Where necessary, an order may be delayed while verification takes place.

We may cancel or decline a transaction where reasonably necessary to prevent fraud or unlawful activity, subject to applicable law.

38. Complaints

If you have a complaint about an order, product, delivery, return, refund or our service, please contact us first.

Please provide your order number and relevant details so that we can investigate the matter.

We will make reasonable efforts to resolve complaints fairly and efficiently.

Nothing in this section prevents a consumer from exercising any statutory right to lodge a complaint with an appropriate regulatory or dispute-resolution body.

39. Dispute Resolution

Where a dispute arises, we encourage customers to contact ALP IT Solutions first so that we can attempt to resolve the matter directly.

We will make reasonable efforts to resolve legitimate complaints without unnecessary formal proceedings.

Nothing in this section prevents either party from exercising a right or remedy available under applicable law.

Where appropriate and where both parties agree, a dispute may be referred to mediation or another alternative dispute-resolution process.

40. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with subject to applicable South African law and any mandatory consumer protections or dispute-resolution mechanisms applicable to the transaction.

The remaining provisions will continue to apply to the extent permitted by law.

43. No Waiver

If ALP IT Solutions does not immediately enforce a provision of these Terms, that does not mean that we have permanently waived our right to enforce that provision.

44. Entire Agreement

These Terms, together with the Privacy Policy, Returns & Refund Policy, Cookie Policy and any other policies expressly incorporated into them, form the principal terms governing your use of the website and purchases from ALP IT Solutions.
